The VisitMorocco.Travel site is owned by the BELKATOURS travel agency located at Av. Des FAR N° 49 Tetouan Morocco, ministry of tourism license n ° ODV-6426 RC: 24690, ICE: 0021299445 .

The use of the VisitMorocco.Travel site or the purchase through this site, are subject to the Conditions of use of the site as well as to the General Conditions of Sale which we recommend that you read carefully, before making a purchase online.


Article 1: Reservation on VisitMorocco.Travel

1.1: Capacity & Use of the site

The function of the Site is to assist the customer in finding services (flights, stays, cruises, organized trips, tours, transfers, experiences, excursions, etc.) in Morocco, to make reservations in accordance with the General Conditions.

Except in the event of fraud of which it is his responsibility to provide proof, the User (client) is financially responsible for all his actions on the Site.

He also guarantees the veracity and accuracy of the information he provides on the website.

Any fraudulent use of this site in violation of these General Conditions will justify at any time the refusal of access to the services offered by www.VisitMorocco.Travel and / or its partners or any other functionality of the Site.

1.2: Validity and acceptance of the offer

Any buyer acknowledges having read these conditions of sale as well as all the terms of the proposal before placing his order. Therefore, taking an order entails the full acceptance of the User (client) of our General Conditions of Sale.

Any derogation for the benefit of the customer does not bring any novation to these conditions. The total or partial nullity of any clause of these Conditions does not in any way nullify the other provisions.

Our prices are expressed in several currencies such as the Euro, the US dollar or the pound sterling, but the payment is in Euros “EUR” with taxes included.

1.3: Confirmation and Payment

Upon payment of the total amount of the online purchase, and payment of the remainder to the agency (particular case of certain products authorized by BELKATOURS) by credit card or any other payment method integrated into the site, the User (customer ) receives the essential elements, such as the identification of the service(s) ordered as well as the price.

VisitMorocco.Travel offers you different payment methods to pay for your online purchases quickly and efficiently. All these payment methods are available when booking online, you just have to click on the method that suits you.

Your payment data is then encrypted and sent via a secure connection.

The voucher and the sales conditions indicating the reservation number will be sent immediately by e-mail.

It is the customer’s responsibility to inquire about and ensure the validity of any administrative and health document, visa and residence permit relating to the police and customs formalities necessary for the execution of the trip and entry into Morocco or any other territory of the destination concerned.

BELKATOURS, owner of VisitMorocco.Travel can in no way be held responsible for an inability to travel, a refusal to enter the territory of the country concerned, or any other situation where the customer would be unable to benefit from the services ordered due to non-compliance with these formalities.


Article 2: Customer service and complaints

All requests for information, clarifications and possible complaints must be sent either by telephone or by email using the contact details on the contact page within 30 days after the end of the stay/service.

Article 3: Protection of personal data

VisitMorocco.Travel is committed to protecting the privacy of its customers, prospects and visitors to its website in compliance with the regulations in force and in particular Moroccan law 09-08.

VisitMorocco.Travel collects or is likely to collect personal data by various processing means such as the Website, mobile applications, the call center, the agency points of sale, etc…

The collected personal data may be processed for the needs of our activities (such as name, first name, national identification number, email, photo, telephone number, etc.), which make it possible to identify or to make the persons concerned identifiable.

These data are processed in a fair, legitimate and transparent manner and in no case transmitted or transferred to an external third party.

 

GENERAL CONDITIONS OF PROVISION OF SERVICES


ARTICLE 1 – GENERAL

The present contract is a distance contract which aims to define the rights and obligations of the parties within the framework of the sale of the products sold on VisitMorocco.Travel on the internet.

VisitMorocco.Travel is a property of BELKATOURS s.a.r.l.

The General Booking Conditions stipulated in this document apply to all products and services provided by BELKATOURS. The customer agrees to comply with these General Booking Conditions which he was aware of before booking and which he accepts without reservation.

These General Conditions shall have their full effect and shall prevail over any other provision except for a written exemption granted by BELKATOURS.


ARTICLE 2 – THE TRAVEL CONTRACT

2.1 Contracting party

The travel contract is concluded with BELKATOURS / VisitMorocco.Travel depending on the type of product(s) or service(s) that the customer reserves.

When the reservation is made with a service provider, VisitMorocco.Travel acts as an intermediary between the customer and this service provider. The contract will therefore be subject to the General Conditions of Sale of this service provider who may limit or exclude his liability without this exclusion of liability meaning an increase in our liability.

The customer can, if necessary, refer to the website of each service provider on the General Conditions of Sale applicable to customers or request any additional information from his travel advisor by telephone or by email.

In all cases, VisitMorocco.Travel can only study complaints involving its direct and proven responsibility.

2.2 Conclusion of the contract

All reservations are made subject to availability.

The customer has the possibility to check the contents and the total price of his reservations as well as to correct any possible error before confirming his order.

Unless otherwise stipulated in these General Booking Conditions, the contract will come into force as soon as VisitMorocco.Travel has received the actual payment from the customer unless different conditions are stated in the product description.

The customer acknowledges having read these General Conditions of Service and having reviewed the conditions of the offer before confirming the purchase of the service and paying for it.

It is the customer’s responsibility to print or save all contract documents.

A copy of the contract will automatically be kept in VisitMorocco.Travel records. Data collected from customers is processed in accordance with the provisions of Moroccan Law N°. 09-08 on the protection of individuals with regard to the processing of personal data.

The customer acknowledges having been informed that there may be handling fees per reservation file and / or per person depending on the product reserved.

The customer will be informed of any costs when confirming his reservation. These booking fees are subject to change without notice and may be increased, reduced or waived.


ARTICLE 3 – RESERVATION

The price of each product or service is regularly reviewed and may vary upwards or downwards. The promotional offers and discounts offered on the website www.VisitMorocco.Travel are offered at our discretion and will remain available for the period indicated in the promotional offer.

All offers are made subject to availability and can be withdrawn at any time.

When making a reservation, the customer guarantees that he accepts these conditions in his name and / or in the name of people included with him in the reservation. If the customer makes a reservation for more than one person, he guarantees to be jointly responsible for all payments due by each of the people for whom he makes the reservation.

It is the customer’s responsibility to ensure that any information provided to him by VisitMorocco.Travel or by one of its suppliers is transmitted to all persons.

Any information transmitted to the customer will be considered as being transmitted to all the people for whom he makes or has made a reservation.


ARTICLE 4 – PAYMENT

The accepted payment methods are as follow:

Payment methods available may be different depending on the product. Available options will be shown at the checkout page.

Only electronic payment methods are accepted for online or telephone bookings unless another method is offered at checkout on VisitMorocco.Travel.

As part of the prevention against the issuance of bad checks and credit card fraud, and in order to protect the customer against fraudulent use of his means of payment, VisitMorocco.Travel may request additional documents, in particular:

If the customer wishes to make a reservation onsite or via the telephone, we reserve the right to ask the customer to provide the following elements:

A simple copy of an identity document of the holder of the means of payment;

A simple copy of the bank card if paying by bank card.

If these documents are demanded and not received within two business days of the reservation request, the order may be canceled by VisitMorocco.Travel, in which case the reservation will be considered as never been existed.

If the customer wishes to make a reservation on the website, www.VisitMorocco.Travel reserves the right to ask the customer, before processing his reservation request, to provide the following elements:

An identity verification form duly completed and signed by the person making the payment by card;

A simple copy of the bank card holder’s identity card;

If these documents are demanded and not received within two business days following the request, VisitMorocco.Travel reserves the right not to act on its reservation request.


ARTICLE 5 – TRAVEL DOCUMENTS

5.1 Electronic tickets (e-ticket)

As of June 1, 2008, following a decision by the International Air Transport Association (IATA) and all airlines, travel agencies no longer have the right to issue paper tickets.

This means that VisitMorocco.Travel will only be able to issue electronic tickets (e-ticket).

When VisitMorocco.Travel will not have the possibility of issuing an electronic ticket, the booking will be taken into account subject to the possibility of obtaining from the supplier a transport ticket in a format accepted and recognized by international conventions.

In the event that the supplier cannot issue the ticket in any form, VisitMorocco.Travel will cancel the customer’s order and his reservation will be considered as never having existed.

In the event of a cancellation of the customer’s reservation, VisitMorocco.Travel, for informational purposes only and without any obligation of result, will inform him of offers equivalent to the canceled order, in order to make his new reservation easier.

5.2 Vouchers

The voucher is issued by VisitMorocco.Travel or Belkatours or its agents in order to allow the customer to use the paid service(s).

The voucher and the rights attached to it are not transferable or exchangeable.

The voucher can also be issued by VisitMorocco.Travel in its capacity as intermediary instead of the supplier. The supplier’s General Conditions of Sale are then mentioned on this document or in the event that they are not, the travel advisers will provide any necessary information.


ARTICLE 6 – MODIFICATION BY THE CUSTOMER

Any request for modification is subject to availability reservations, as well as to the limitations and restrictions provided by BELKATOURS.

If the modification results in an increase in the price of the reservation, the customer will have to pay the additional costs plus the modification fee if applicable. However, in the event that the reservation price is lower after modification, the refund of the difference is made taking into account the modification costs if applicable.

In all cases, if the customer wishes to modify all or part of his reservation, VisitMorocco.Travel administrative fees will apply, unless special mention or exemption specifying the specific conditions applicable to the reservation.


ARTICLE 7 – CANCELLATION BY THE CUSTOMER

In the event of cancellation of a reservation, the administration fees, service fees, insurance and modification fees are not refundable, if applicable.

The aforementioned cancellation costs are defined according to the nature of the service purchased and the general conditions of sale of the service provider for which VisitMorocco.Travel is an intermediary. It is up to the customer to inquire.

If the description of the product mentions “free cancellation” the free cancellation period (for example 24 hours or 7 days before) is mentioned in the description and the customer is refunded in full as long as he makes the cancellation before the date and time limit.


ARTICLE 8 – LACK OF REGISTRATION OR NO SHOW

If the customer has a reservation for one of VisitMorocco.Travel products or services, but does not show up at check-in to benefit from said product or service, it will not be possible to obtain a refund.


ARTICLE 9 – INSURANCE

9.1 insurance contract

It is the customer’s responsibility to take out adequate insurance to cover (at a minimum) the expenses incurred in the event of a cancellation as well as the costs of assistance, in particular repatriation, in the event of accident or illness at the time of cancellation.

It is also the customer’s responsibility to comply with the requirements of the insurance company and the duty to provide it with all accurate and necessary information when taking out the contract.

Sales of packaged products (including flight, transfer, accommodation and / or tours) provide for travel assistance insurance, the terms and characteristics of which are defined in the general conditions provided by the insurance company and of which the customer declares to be informed.

It is important to note that BELKATOURS or VisitMorocco.Travel is in no way responsible for criminal offenses committed by its employees, agents and suppliers except in the event of gross or willful misconduct on the part of BELKATOURS as an intermediary.

9.2 cancellation of the insurance policy

All insurances must be purchased and paid for at the time of booking and are non-refundable.


ARTICLE 10 – INFORMATION, PASSPORTS, VISAS AND HEALTH

It is the customer’s responsibility to be informed of the health risks relating to the country(s) of destination.

The customer should seek advice on vaccinations and precautions that may be mandatory or recommended from a specialist (including a general practitioner, a nurse, a pharmacist or a clinic), ideally at least 8 weeks before the date of departure.

It is the customer’s responsibility to:

check with the embassy or consulate concerned if they need a visa to enter the territory of Morocco.

If the customer does not comply with these formalities, he will be solely responsible for the costs, losses or damage incurred by himself or by VisitMorocco.Travel as a result of this failure.

The client should include all stages of their trip, which may also require obtaining a visa. It should be noted that many countries including Morocco require that the client’s passport be valid for another six months after the period of their stay.

The client must ensure that his passport is legible and intact. Any trace of deterioration could result in the denial of boarding or entry into the destination territory.

The name on the passport must be the same as the name on the ticket. Otherwise, the customer may be unable to travel and the insurance may be inoperative.


ARTICLE 11 – HOTEL RESERVATION / ACCOMMODATION ONLY

11.1 Star rating

The star rating symbolizes the overall quality, the level of service and catering and the services offered by the establishment. The rankings in effect in each country vary according to the specific criteria applied by the local body establishing the ranking and are provided for informational purposes only. They do not constitute any guarantee of any kind on the part of VisitMorocco.Travel.

11.2 Hotels

The customer should refer to the detailed description of the establishment for any other rules applicable to his trip. The customer must be at least 18 years old to book a stay on www.VisitMorocco.Travel.

It should be noted that the hotels reserved by VisitMorocco.Travel for its customers are not exclusive to it.

 www.VisitMorocco.Travel can in no way be held responsible for any restrictions on services due to the arrival of other customers or their activities.

 www.VisitMorocco.Travel is in no way responsible for the information concerning the hotels presented on the website www.VisitMorocco.Travel (in particular the images, the list of available services, etc.).

It is possible that hotels change their facilities and characteristics without prior notice, and it is therefore the customer’s responsibility to confirm the available services directly with the establishment before their trip.

11.3 Local taxes and service charges which are not included in the hotel price

Please note that taxes and service charges, which are not paid at the point of sale, may be levied abroad. The customer must pay all such taxes and local charges directly to the establishment upon arrival or departure.


ARTICLE 12 – CLAUSES SPECIFIC TO FLIGHTS

12.1 Flight schedules

In the itinerary provided by VisitMorocco.Travel, flight times are given only for information.

All departure / arrival times on the flight ticket are provided by the relevant airlines and are estimates only.

Schedules may change based on air traffic control restrictions, weather conditions, operational or maintenance requirements, and passengers’ obligations to check-in on time.

 www.VisitMorocco.Travel is not responsible for changes in departure or arrival times compared to the times initially communicated or indicated on the ticket or for any other modification of the flight by the airline.

In addition, when one section of the flight (outbound, for example) is not completed, the other sections (the return, for example) may be canceled without notification. In this event,  www.VisitMorocco.Travel will not be able to assume responsibility for any of the costs incurred by the customer.

For all air travel, it is the customer’s responsibility to check the departure and arrival times of their flights at the time of travel.

For this reason, the customer must confirm his flights with VisitMorocco.Travel in accordance with the confirmation deadline of the airline concerned.

VisitMorocco.Travel will not be able to put in place a special procedure if the customer arrives late at the airport, these matters being at the sole discretion of the airline concerned. The times written on the ticket or itinerary are the flight departure times.

Check-in times, as recommended by the carrier or the airline’s timetables, are the cut-off times during which passengers can be accepted, including the time required to complete all formalities.

Flights cannot be held for late passengers and www.VisitMorocco.Travel cannot be held responsible in such cases.

12.2 Taxes, fees and charges imposed by the government

The price of the flight may include taxes, fees and charges imposed on air travel by government authorities. They can represent a significant part of the cost of the trip and are either included in the ticket price or shown separately on the ticket.

The customer may also be required to pay taxes, fees or charges that have not already been collected.

In some cases, the ticket price may change at the time of booking due to some external circumstances such as fuel surcharge or a synchronization problem, in a similar situation VisitMorocco.Travel will contact the customer in 48 hours to pay the difference otherwise the customer has the right to get full refund and the ticket will be canceled. If more than 48 hours have passed after purchasing the ticket without being contacted by VisitMorocco.Travel due to a price change, the customer has no obligation to pay the difference and VisitMorocco.Travel is supposed to cover it.


12.3 Denied boarding, cancellation or delay of flights

In the event of denied boarding, cancellation or delay of flights, the customer must first file a complaint with the airline directly.

12.4 Seat allocation

 www.VisitMorocco.Travel has no control over the allocation of airline seats. If the customer has special seating requests, they should check in as early as possible at the airport. VisitMorocco.Travel cannot guarantee the customer that their requests will be met.

12.5 Baggage

Baggage is subject to variation depending on airline, class and / or route. The customer must take the minimum of cabin baggage.

The customer may be required to pay additional charges for checked baggage beyond what is permitted.

For safety reasons, the customer must not carry dangerous objects in their cabin or hold baggage. Such objects are, in particular, compressed gas, corrosive substances, explosive substances, liquid or solid flammable substances, radioactive materials, oxidants, poisons, infectious substances and cases with integrated alarm systems.

It should be noted that specific regulations apply to liquids carried in cabin baggage.

12.6 Direct flights

It should be noted that the word “direct” indicated on the ticket does not necessarily mean that the flight will be non-stop, but only that the customer will not need to change planes during their trip.

12.7 Pregnancy and children

Some airlines refuse to carry women who will be 28 weeks pregnant or older on the return trip. The customer will need to contact the airline directly, which might have different rules and will also need to consult their attending physician. Infants must be 6 weeks or older to board the plane and must either sit on an adult’s lap or in a child seat.

The customer should request more information from their travel advisor and contact the airline they wish to travel with for further information regarding appropriate seats. In general, children aged 2 or over must occupy a full seat.


ARTICLE 13 – CUSTOMER BEHAVIOR

It is recommended that the customer learn about the rules, laws and customs applicable in Morocco. The customer must in all cases comply with the rules applicable throughout the duration of his stay, as well as all the rules relating to entering and leaving the country.

VisitMorocco.Travel cannot be held liable for any damage and / or inconvenience suffered by the customer, whether caused by his behavior or that of third parties. It is the client’s responsibility to ensure that he or any member of his group does not behave in a manner that is inappropriate or that could endanger, torment, injure or harm others or that could damage property belonging to other people (including drunkenness or aggressive behavior) while traveling.

In the event that his behavior would appear inappropriate or would seem inappropriate to one of VisitMorocco.Travel staff members or suppliers and would endanger, torment, injure or harm other people or risk damaging property belonging to other people, VisitMorocco.Travel and / or its suppliers will be obliged to take appropriate measures to ensure the safety and comfort of its customers and their property and those of its suppliers.

These measures may include terminating the trip, in which case the commitments of VisitMorocco.Travel and those of its suppliers to the customer would cease immediately and he could not claim any reimbursement or compensation relating to the costs or expenses resulting from such termination. In addition, the customer must reimburse all costs relating to such termination.

 

ARTICLE 14 – IN THE EVENT OF A CLAIM

In the event of a complaint, the customer should contact the appropriate supplier.

If the supplier is not able to resolve the problem at the customer’s convenience, the latter can contact  www.VisitMorocco.Travel by email at the following address customerservice@VisitMorocco.Travel.

In the event that the customer’s request cannot be met immediately, the latter must inform  www.VisitMorocco.Travel by registered letter with acknowledgement of receipt, as soon as possible.

The customer must send a registered letter with acknowledgement of receipt within 30 days of his return to  www.VisitMorocco.Travel, 49 avenue des FAR Tétouan Morocco, entering the reference of his reservation and giving all the necessary information.

A delay in notification could prevent  www.VisitMorocco.Travel from processing the request and / or prevent it from carrying out an in-depth investigation, which could have consequences on the possibility of receiving compensation.


ARTICLE 15 – RESPONSIBILITY

15.1 Scope of liability

It is important to note that VisitMorocco.Travel is a service provider. As such, VisitMorocco.Travel is responsible as a professional in the context of the direct services it provides. Its liability can only be called into question in the event of gross negligence or proven culpable negligence.

In this case, it is responsible for direct and proven damage suffered by the customer and not for indirect damage, loss of profit, loss of profit or others.

15.2 Confirmation of the reservation

The customer should ensure that he is traveling in possession of his booking confirmations, electronic tickets, appropriate visas and other travel documents (including passport). www.VisitMorocco.Travel will in no way be responsible in the event that a supplier refuses to deliver the reserved product or service to the customer if the latter is not in possession of these documents.

15.3 Important information on limitations of liability

Regarding international travel, VisitMorocco.Travel’s liability towards the customer will be limited or excluded in accordance with international conventions.

BELKATOURS, owner of VisitMorocco.Travel, is recognized as a travel and holiday agency and a tour operator and, as such, does not control or manage airlines, shipping or rail companies.

Travel may be subject to certain international conventions, in particular the Warsaw Convention of October 12, 1929 and the Montreal Convention of May 28, 1999 (relating to international air transport), the Athens Convention of December 13, 1974 (relating to international transport by sea) or COTIF of 9 May 1980 (convention relating to international carriage by rail), as amended or supplemented.

The customer accepts that the “Conditions of carriage” of the carriers or transport companies apply during his trip.

The customer acknowledges that all the general conditions of sale contained in the “Conditions of transport” form part of his contract with VisitMorocco.Travel and with the transport company and that these “Conditions of transport” will be considered as included by reference in his contract.

15.4 Events excluding the responsibility of VisitMorocco.Travel and FORCE MAJEUR

VisitMorocco.Travel will never be held liable if the non-performance of its obligations results from:

an unforeseeable and insurmountable action or omission by a third party that has no connection with the service sold;

any action or omission on the part of the customer;

a case of Force Majeure as defined by articles 268 and following Moroccan law and the Dahir of Obligations and Contracts.


ARTICLE 16 – WEATHER

VisitMorocco.Travel cannot be held responsible for travel disruption due to bad or unusual weather conditions.


ARTICLE 17 – SPECIAL ASSISTANCE

If the customer is disabled or of reduced mobility or if he requires special assistance for any reason, he must notify  VisitMorocco.Travel at the time of booking. In the event that these requirements change before departure, the customer must inform VisitMorocco.Travel. VisitMorocco.Travel cannot be held responsible subsequently for any losses that the customer may suffer in the event that it or its suppliers cannot meet the customer’s requirements.


ARTICLE 18 – SPECIAL REQUESTS

The customer is required to inform VisitMorocco.Travel of any special requests he may have, which will forward them to the appropriate department or supplier. However, VisitMorocco.Travel does not guarantee the follow-up to these special requests because it has no direct control over the way in which the services are provided.

YOUR PERSONAL DATA:

No personal information is collected without your knowledge. In a logic of respect for private life, VisitMorocco.Travel undertakes to ensure that the collection and processing of personal information is carried out in accordance with Moroccan Law No. 09-08 of February 18, 2009 on the protection of individuals with regard to the processing of personal data. No personal information is disclosed to third parties. In accordance with the provisions of Law 09-08, VisitMorocco.Travel guarantees the user a right of access and rectification, and opposition to personal data concerning him.
